Right of Burial

For over 200 years St. John’s Cemetery on the Humber has been guided by the fundamental principle that the burial grounds were to be used exclusively for the burial of Blood Descendants of Captain John Denison and their husbands and wives.

The definition of “Blood Descendant” and “Spouse” shall be interpreted as follows for the purposes of determining eligibility for burial within the Cemetery:

 

  1. A Blood Descendant is any person who has an unbroken chain of ancestry backward to Captain John Denison through either maternal or paternal parentage and includes any child naturally born to a Blood Descendant or whose adoption is recognized by the province of Ontario.
  2. A Spouse of a Blood Descendant is a person who, at the time of that person’s death
    1. is married to or is living in a common-law relationship (for minimum 3 years) with a living Blood Descendant or,
    2. was married to or was living in a common-law relationship (for minimum 3 years) with a Blood Descendant at the time of the Blood Descendant’s death.

Marriage and common-law relationships are relationships as defined by the laws of Ontario.

Eligibility for burial does not:

1. extend through a Spouse to include non-Blood Descendants or,

2. include natural or adopted children of a Spouse from a relationship with a non-Blood Descendant unless the child is legally adopted by the Blood Descendant.

The Board of Directors of St John’s Cemetery on the Humber has the exclusive responsibility to ensure that only eligible persons are interred within the Cemetery.
